Welcome to Digital Mart AU.
These Terms & Conditions (“Terms”) govern your access to and use of the Digital Mart AU website, including purchases of physical and digital products through our website.
By accessing our website, creating an account, placing an order, or purchasing a product, you agree to these Terms.
Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law (ACL) or other applicable Australian law.
For questions regarding these Terms, contact:
Email: support@digitalmartau.com
1. About Digital Mart AU
Digital Mart AU operates an online store offering physical and digital products.
Product availability, features, pricing and delivery methods may vary between products. Please review the relevant product description before completing a purchase.
2. Eligibility to Purchase
By placing an order through our website, you confirm that:
- The information you provide is accurate and complete;
- You are legally capable of entering into the transaction; and
- You are authorised to use the payment method provided.
Where a particular product has additional eligibility, licensing or usage requirements, these may be stated on the relevant product page.
3. Product Information
We make reasonable efforts to ensure that product descriptions, specifications, images, prices and availability information displayed on our website are accurate and current.
Images may be provided for illustrative purposes, and appearance may vary depending on screen settings or legitimate product variations.
For digital products, screenshots, previews or demonstrations may illustrate the product or its functionality.
Nothing in this section limits your rights where a product does not correspond with its description or otherwise fails to meet an applicable consumer guarantee.
4. Pricing
Prices displayed on our website are shown in the currency indicated at checkout.
Any applicable shipping charges, taxes or other charges will be displayed or calculated during checkout where applicable.
Prices, discounts and promotions may change from time to time. A price change will not ordinarily affect an order that has already been accepted, except where required or permitted by law.
5. Orders
Submitting an order constitutes an offer to purchase the selected products.
After an order is submitted, you may receive an automated order confirmation. An automated confirmation acknowledges receipt of your order but does not necessarily mean that the product has been dispatched or, where applicable, that digital access has been completed.
We reserve the right to decline or cancel an order where reasonably necessary, including where:
- A product is unavailable;
- An obvious pricing or listing error has occurred;
- Payment cannot be authorised;
- We reasonably suspect fraud or unauthorised activity;
- We cannot fulfil the order; or
- The transaction would violate applicable law or payment-provider requirements.
Where we cancel an order after receiving payment and no product has been supplied, we will provide an appropriate refund.
6. Payments
Payments may be processed by third-party payment providers, including Stripe.
You agree to provide accurate and authorised payment information.
Payment information may be processed directly by the relevant payment provider and will also be subject to that provider’s applicable terms and privacy practices.
Use of a payment provider does not reduce or replace your statutory consumer rights.
7. Physical Products
Physical products will be delivered to the shipping address supplied during checkout.
Customers are responsible for checking that their delivery information is accurate before completing an order.
Processing and delivery times may vary according to product availability, destination, courier operations, weekends, public holidays and circumstances outside our reasonable control.
Any delivery timeframe displayed on our website is an estimate unless expressly stated otherwise.
Further information is available in our Shipping & Digital Delivery Policy.
8. Digital Products
Digital products may be delivered electronically through a download link, email, customer account or another method described on the relevant product page.
Digital products do not require physical shipping.
Customers are responsible for reviewing any disclosed compatibility or technical requirements before purchasing.
Where applicable, access to a digital product is provided for the purchaser’s personal or authorised business use in accordance with the licence or usage terms associated with that product.
If you experience a legitimate digital-delivery or access problem, contact support@digitalmartau.com.
9. Digital Product Licence and Usage
Unless otherwise stated on the applicable product page or licence terms, purchasing a digital product gives you a limited right to use that product for its intended purpose.
Purchasing a digital product does not automatically transfer copyright, trademarks or other intellectual-property ownership to the purchaser.
Unless expressly permitted by us or by the applicable licence, you must not:
- Resell, redistribute or sublicense a digital product;
- Share paid download links or account credentials with unauthorised persons;
- Claim our content as your own;
- Reproduce products for unauthorised commercial distribution; or
- Circumvent technological measures used to control access to digital products.
Some digital products may have different licensing conditions. Where specific licence terms are displayed before purchase, those terms also apply.
10. Returns, Refunds and Cancellations
Returns, refunds and cancellations are handled according to our Returns & Refunds Policy and applicable Australian law.
We generally do not provide refunds solely for change of mind unless we have expressly offered a change-of-mind return.
For digital products, a change-of-mind refund may not be available after the product has been downloaded, accessed, activated or otherwise supplied.
However, these conditions do not exclude your rights under Australian Consumer Law where applicable.
The ACCC confirms that businesses cannot use store policies or terms and conditions to remove consumer-guarantee rights.
11. Australian Consumer Law
Our goods and services come with consumer guarantees that cannot be excluded where the Australian Consumer Law applies.
Depending on the circumstances, if a product or service fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation or other remedy.
Nothing in these Terms is intended to exclude, restrict or modify a guarantee, right or remedy that cannot legally be excluded.
12. Promotions and Discount Codes
From time to time, Digital Mart AU may offer sales, promotional prices, discount codes or other special offers.
Promotions may be subject to specific conditions, including:
- Validity periods;
- Eligible products;
- Minimum order amounts;
- Usage limits; or
- Other conditions disclosed with the promotion.
Unless otherwise stated, promotional offers cannot necessarily be combined.
We may withdraw or modify a promotion before it is used, subject to applicable law. We will not use promotional terms to remove rights already acquired by customers or rights available under Australian Consumer Law.
13. Customer Accounts
Certain website features may allow or require customers to create an account.
You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account where authorised by you.
Please notify us promptly if you believe your account has been accessed without authorisation.
We may suspend or restrict an account where reasonably necessary to protect our website, customers or business from fraud, security threats or misuse.
14. Intellectual Property
Unless otherwise stated, content made available through Digital Mart AU, including website design, text, graphics, logos, original photographs and other original materials, may be protected by intellectual-property laws.
You may use the website for ordinary personal shopping and other authorised purposes.
You must not reproduce, republish, commercially exploit or distribute our protected content without permission, except where permitted by law.
Third-party names, trademarks, logos and content remain the property of their respective owners.
15. Acceptable Use
You must not intentionally use our website to:
- Commit or facilitate fraud;
- Attempt unauthorised access to systems or accounts;
- Introduce malicious software;
- Interfere with website operation or security;
- Scrape or extract protected content in an unauthorised manner;
- Use another person’s payment information without authorisation;
- Submit false information for fraudulent purposes; or
- Engage in unlawful activity.
We may take reasonable steps to protect our website and customers where misuse is detected.
16. Fraud Prevention
We may use reasonable fraud-prevention and security measures when processing transactions.
An order may be temporarily held, reviewed or cancelled where there are reasonable grounds to suspect fraudulent or unauthorised activity.
We may request additional information where reasonably necessary to verify an order.
These measures will not be used to unlawfully deny a customer rights available under Australian Consumer Law.
17. Payment Disputes and Chargebacks
If you believe there is a problem with an order, please contact us at support@digitalmartau.com so we have an opportunity to investigate and resolve the matter.
We may retain and provide relevant transaction records to our payment provider or financial institutions when responding to a payment dispute. These may include order details, delivery or tracking information, digital-delivery/access records, communications and evidence relating to the customer’s acceptance of applicable terms, subject to applicable privacy law.
Nothing in these Terms prevents you from exercising any lawful right to dispute a transaction.
Stripe provides separate guidance to businesses concerning payment disputes and supporting evidence. Stripe – Payment disputes guide
18. Third-Party Services
Our website may use or link to third-party services, including payment processors, shipping providers, analytics providers or other technology platforms.
Third-party services may be subject to their own terms and privacy policies.
We are not responsible for independent third-party websites merely because our website contains a link to them.
Nothing in this section limits any responsibility we have to you that cannot legally be excluded.
19. Website Availability
We aim to keep our website accessible and functioning properly but cannot guarantee uninterrupted or error-free availability.
Access may occasionally be interrupted due to maintenance, updates, technical problems, security incidents or circumstances outside our reasonable control.
Where an outage affects a paid digital product or service, we will address any resulting customer rights in accordance with applicable law.
20. Limitation of Liability
To the maximum extent permitted by law, Digital Mart AU excludes liability that may lawfully be excluded.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded under Australian Consumer Law or another applicable law.
Where liability may lawfully be limited, any limitation will apply only to the extent permitted by law.
21. Privacy
Personal information collected through our website is handled in accordance with our Privacy Policy and applicable privacy laws.
Our Privacy Policy explains the types of information we may collect, why we collect it, how it may be used or disclosed, and how you can contact us regarding privacy matters.
22. Changes to These Terms
We may update these Terms from time to time to reflect changes to our website, products, business practices or legal obligations.
Updated Terms will be published on our website with a revised “Last Updated” date.
Changes will not retrospectively remove statutory rights or remedies that have already arisen.
23. Governing Law
These Terms are governed by the laws applicable in New South Wales, Australia, and applicable Commonwealth laws.
Nothing in this section is intended to restrict any jurisdictional rights that a consumer may have under applicable law.
24. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or limited to the extent necessary and permitted by law.
The remaining provisions will continue to apply.
